Rotational Molding Technologies, Inc., doing business as RomoTech ("RomoTech," "Company," "we," "us," or "our"), owns and operates the website located at romotechplastics.com, including all subdomains and successor URLs (the "Site"). These Terms of Use ("Terms") govern your access to and use of the Site and the content, tools, and materials made available on it.

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU ARE ACCESSING THE SITE ON BEHALF OF A COMPANY, DEALER, DISTRIBUTOR, OR OTHER ORGANIZATION (YOUR "ORGANIZATION"), YOU REPRESENT THAT YOU ARE AUTHORIZED TO ACCEPT THESE TERMS ON ITS BEHALF, AND "YOU" REFERS TO BOTH YOU INDIVIDUALLY AND YOUR ORGANIZATION. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SITE.

These Terms govern use of the Site only. They do not govern the purchase or sale of goods. Any sale of RomoTech products is governed by a separate quotation, purchase order, order acknowledgment, invoice, and/or written sales agreement between you and RomoTech.

1. Business-to-Business Site; No Consumer Sales

The Site is intended solely for business customers, distributors, dealers, contract manufacturing partners, suppliers, and other commercial parties ("Business Users") in connection with their business dealings with RomoTech. The Site is not directed to, and may not be used by, individual consumers for personal, family, or household purposes, and RomoTech does not sell products through the Site to members of the general public. Access to restricted areas of the Site requires a valid login issued by RomoTech, and RomoTech may restrict, condition, or deny access to any person or organization in its discretion.

2. Eligibility and Account Registration

To access restricted areas of the Site, you must register for an account and be issued login credentials by RomoTech or its authorized representative.
You must provide accurate, current, and complete information when registering and keep that information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, and must notify RomoTech promptly of any suspected unauthorized use.
If you registered on behalf of an Organization, your Organization is responsible for your compliance with these Terms, and RomoTech may transfer or reassign account access to another authorized representative of the Organization if your affiliation with it ends.
RomoTech may suspend or terminate your account or access to the Site at any time, with or without notice, for conduct that RomoTech believes violates these Terms or is harmful to RomoTech, other users, or third parties.

3. Quotes, Orders, and Inquiries

Submitting a request through the Site's "Custom Project Quote," "Product Pricing Request," or similar forms is an inquiry only and does not constitute an order, offer, or binding agreement. Any resulting sale of goods will be governed by a separate quotation, purchase order, order acknowledgment, invoice, and/or written sales agreement between you and RomoTech.

4. Intellectual Property

The Site and all content on it — including text, graphics, logos, product designs, specifications, photographs, videos, software, and the selection and arrangement of that content — is owned by RomoTech, its affiliates (including Buyers Products Company), or their licensors, and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

"RomoTech," the RomoTech logo, and other marks displayed on the Site are trademarks of Rotational Molding Technologies, Inc. or its affiliates. Other product or company names referenced on the Site may be trademarks of their respective owners; such references are for identification or descriptive purposes only and do not imply affiliation with, sponsorship by, or endorsement from those owners unless expressly stated.

Except as expressly permitted under Section 5 (Use of RomoTech Content by Business Partners) or with RomoTech's prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site.

5. Use of RomoTech Content by Business Partners

RomoTech permits its business partners to reference and republish certain RomoTech content on their own websites, catalogs, and marketing materials, subject to the following conditions:

General. RomoTech's brands, content, media, and logos remain the property of Rotational Molding Technologies, Inc. Use of any RomoTech content must present RomoTech in a positive light, and RomoTech may require that content be removed if used in a manner it deems inappropriate.
Logos. Logos must be used as provided, without modification, cropping, or alteration of any element.
Photos and Videos. Photographs and videos are copyrighted and must be used as presented; they may be resized but not otherwise altered without RomoTech's prior written permission. Videos may be embedded provided a link to the original video is included.
Specifications. Product specifications must be used as published. If you believe a specification is in error, please contact RomoTech through the Contact Us page so it can be corrected.
Articles. Written articles may be republished provided authorial credit is given and a link back to the original article is included.

6. Prohibited Uses

You agree not to:

use the Site for any unlawful purpose or in violation of these Terms;
attempt to gain unauthorized access to any account, system, or network connected to the Site;
interfere with or disrupt the Site's operation, security, or availability, including through malware, scraping, or automated data collection not expressly authorized by RomoTech;
misrepresent your identity or affiliation, or share your login credentials with any person or organization not authorized to use them;
copy, resell, or commercially exploit the Site or its content beyond what is permitted in Section 5; or
submit false, misleading, or fraudulent information through the Site.

7. Product Information and Specifications

RomoTech provides product descriptions, specifications, drawings, capacities, and measurements on the Site for general reference. Measurements and specifications are nominal and subject to change without notice. RomoTech does not warrant that product descriptions or other Site content are accurate, complete, current, or error-free. Any brand or manufacturer names referenced on the Site for descriptive or compatibility purposes do not imply affiliation with, or endorsement by, those manufacturers unless expressly stated.

8. Third-Party Links

The Site may contain links to third-party websites that are not owned or controlled by RomoTech. RomoTech is not responsible for the content, accuracy, security, or practices of any linked third-party site, and inclusion of a link does not imply endorsement. You access any linked third-party site at your own risk.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ROMOTECH DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. THIS SECTION DOES NOT LIMIT OR AFFECT ANY PRODUCT WARRANTY EXPRESSLY PROVIDED IN A SEPARATE WRITTEN SALES AGREEMENT BETWEEN YOU AND ROMOTECH.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROMOTECH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT ROMOTECH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ROMOTECH'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). NOTHING IN THIS SECTION LIMITS LIABILITY ARISING UNDER A SEPARATE WRITTEN SALES AGREEMENT BETWEEN YOU AND ROMOTECH.

11. Indemnification

You agree to indemnify, defend, and hold harmless RomoTech and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.

12. Privacy

RomoTech's collection, use, and disclosure of information in connection with the Site is described in RomoTech's Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you agree to the practices described in that policy.

13. Export Compliance

You agree to comply with all applicable U.S. and foreign export control and economic sanctions laws and regulations in connection with your use of the Site and any products or technical information obtained through it.

14. Changes to These Terms

RomoTech may modify these Terms at any time by posting a revised version on the Site with an updated Effective Date. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law; Venue

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Elkhart County, Indiana, and you consent to the personal jurisdiction of those courts.

16. Miscellaneous

Entire Agreement. These Terms, together with the Privacy Policy and any other policies referenced in these Terms, constitute the entire agreement between you and RomoTech regarding use of the Site and supersede any prior agreements regarding the Site.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. RomoTech's failure to enforce any provision of these Terms is not a waiver of its right to do so later.
Assignment. You may not assign these Terms without RomoTech's prior written consent. RomoTech may assign these Terms to any affiliate or successor without restriction.
No Third-Party Beneficiaries. These Terms do not create rights for any person or entity other than you and RomoTech.
